Terms of Service for Quellina

1. Scope
These Terms govern the use of the Quellina website and Progressive Web App by visitors and registered users.
Quellina is an information-only outdoor utility radar. Deviating terms only become part of the usage relationship if the operator expressly agrees to them.
2. Service description
Quellina provides map information on water sources, shelters, wilderness huts and other outdoor POIs. Base data comes primarily from OpenStreetMap; current condition reports may come from the community.
Quellina is not a navigation, warning, rescue or emergency system. The displayed information is not an official inspection, real-time measurement or guarantee of any particular condition or availability.
3. Registration and status reports
Reading the map is generally possible without an account. Community status reports require sign-in via Magic Link. Users must use a reachable email address assigned to them and protect access to that email account.
Technical reporting limits apply per POI. Circumvention attempts, automated mass reports and multiple accounts for manipulation are prohibited.
4. User obligations
- Status reports may only be submitted to the best of the user’s knowledge and preferably based on a personal, current observation.
- False, misleading, unlawful or manipulated reports are prohibited.
- The platform may not be disrupted, automatically scraped, abusively overloaded or used to collect personal data.
- Users remain solely responsible for their trip planning, equipment and decisions.
5. Water sources and outdoor POIs
Labelling a water source or a community report only describes the recorded or most recently reported condition. Untreated natural water may contain pathogens or pollutants. Sources can run dry and shelters can be damaged, closed or inaccessible.
Users must not rely exclusively on Quellina, especially in time-critical or dangerous situations. Quellina does not replace personal precautions, local notices or emergency services.
6. Availability and changes
The operator aims to provide reliable operation but does not guarantee uninterrupted availability. Functions and displays may be adjusted or discontinued for technical, legal or security reasons.
OpenStreetMap, Overpass, tile servers, hosting and authentication services are partly operated by third parties. Their outages or changes may affect use.
7. Moderation and suspension
The operator may remove obviously inaccurate or abusive reports, restrict functions and suspend accounts in the event of serious or repeated violations. Statutory rights and obligations remain unaffected.
8. Usage rights
By submitting a status report, the user grants the operator the simple usage rights required for storage, aggregation, display and moderation. These rights are limited to the scope necessary for platform operation.
OpenStreetMap content is subject to the applicable licence and attribution conditions. Reuse outside Quellina may entail additional obligations.
9. Warranty and liability
The operator does not guarantee the correctness, completeness, timeliness or usefulness of OpenStreetMap data, community reports or external services.
The operator is liable in accordance with statutory provisions for intent and gross negligence and for injury to life, body or health. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable, typical contractual damage. Mandatory statutory liability remains unaffected.
Liability limitations do not apply where they would be unlawful.
10. Privacy and local storage
Information on the processing of personal data, Supabase, Vercel, OpenStreetMap, Matomo, geolocation and local PWA/offline storage is contained in the Privacy Policy.
11. Term and termination
The usage relationship runs for an indefinite period. Users may stop using the service at any time. Where an account deletion function is offered, it can be requested via that function or by contacting the operator. Statutory retention obligations remain unaffected.
12. Final provisions
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods, insofar as mandatory consumer protection is not restricted. For consumers, the statutory places of jurisdiction apply.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
